Democracy and Constitutionalism

This seminar consists of two parts: First, we will discuss a number of accounts of the underlying principles of democratic institutions—e.g., respect of various sorts for our fellow citizens, the epistemic value of democratic decision-making, and the good effects of such a system on the character of the citizenry. Second, we will consider whether the institution of judicial review is inconsistent with, compatible with, or an implication of the principles surveyed in the first part of the course. We will read the work of a number of democratic theorists and legal scholars, including (to name only a few): Ronald Dworkin, Jeremy Waldron, Thomas Christiano, and Justice Stephen Breyer. .
